QUETTA: Senior parliamentarian, Nawabzada Haji Mir Lashkari Raisani submitted an application to the election commission for stopping the bye-elections on NA 265. On Sunday, Mr. Raisani’s lawyers including Riaz Ahmed Advocate, and Sohail Rajput Advocate submitted the application with Nazeer Ahmed Harifal, the returning officer for NA 265. In his application, Mr. Raisani termed the bye-polls on NA 265 as a contempt of court.
In the application submitted to the Returning Officer, it has been stated that Nawabzada Lashkari Khan Raisani, the election candidate for National Assembly Constituency NA 265, has challenged the notification of the victory of Qasim Suri in the 2018 elections from this constituency in the Election Tribunal of Balochistan High Court.
What happened and the Election Tribunal nullified the victory of Qasim Khan Suri and ordered re-election in NA 265 on September 27, 2019. Qasim Suri filed an appeal in the Supreme Court against the order of the Election Tribunal and the notification of the Election Commission on October 2, 2019.
And by suspending the notification of the Election Commission, it issued a stay till the final decision. Therefore, the election on NA 265 will be a violation of the order of the Supreme Court and an interference in the judicial proceedings, and until the final decision of the case, this constituency will be held.
There can be no re-election. If elections are held in the constituency before the decision, it will be contempt of court. The petition says that before Qasim Suri resigned on the basis of stay, the speaker should have informed the National Assembly that the said seat is under judicial stay. Resigned from his seat without informing the Speaker.
