Muhammad Faizan Aslam Khan: President Asif Ali Zardari has imposed emergency in Khyber Pakhtunkhwa under Article 232 of the Constitution, citing the alarming escalation of terrorist incidents and the grave deterioration of law and order in the province.
According to the presidential proclamation, terrorist attacks have intensified to an extraordinary degree, posing severe threats to the lives and property of citizens. Government installations, critical infrastructure, and law enforcement agencies have increasingly come under attack. The statement further noted that the provincial government has failed to demonstrate the necessary resolve and measures to effectively counter terrorism and lawlessness.
The declaration referenced a report submitted by the Governor of Khyber Pakhtunkhwa, which highlighted constitutional breakdown in the province and the inability of the provincial government to function in accordance with the Constitution. In light of this situation, the President deemed immediate constitutional action essential.
The emergency has been enforced under Article 232(1) and Article 234(1) of the Constitution. The proclamation stipulates that the provincial government cannot be run in accordance with constitutional requirements under the prevailing circumstances. Consequently, the federal government may direct the Governor of Khyber Pakhtunkhwa to assume all or part of the functions of the provincial government.
Under these provisions, the Governor will exercise powers delegated by the federal government, including those of provincial institutions and authorities. The powers of the provincial assembly will be exercised by Parliament or under its authority. Furthermore, the Chief Minister, provincial ministers, advisers, special assistants, and the Advocate General will immediately vacate their offices.
The presidential proclamation has taken effect immediately.
