Poor performance of CS shatters governance in Balochistan: BHC

QUETTA: A division bench of the Balochistan High Court (BHC) has dismayed over the performance of Chief Secretary (CS) Balochistan. The bench expressed serious concern over CS performance during the hearing of the constitutional petition with regard to various issues relating to Quetta, the provincial capital.

The Balochistan Bar Council (BBC) office-bearers including Rahib Khan Buledi, Munir Ahmed Khan Kakar, Naseebuallah Tareen Advocate, and others had filed the constitutional petition regarding various issues relating to Quetta.

Bench comprises of Justice Kamran Khan Malakhail and Mr. Justice Rozi Khan Bareech 

The bench comprising Mr. Justice Kamran Khan Malakhail and Mr. Justice Rozi Khan Bareech observed that the poor performance of the Chief Secretary has completely shattered and deteriorated governance in the province. “None including the Chief Executive ask about the performance of the CS”, the bench mentioned.

We are dismayed to observe here that 90% of litigation in the original jurisdiction of this court under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, are related to violation of fundamental rights and ill-governance of the government department by the respective Administrative Heads/Secretaries, the bench remarked.

No violation of building code: the Bench orders 

The BHC also directed the concerned quarters not to allow any individual or institution to violate the building code established by the English rulers in 1937. No residential building shall be allowed to be converted into a commercial building.

No permission for the construction of the commercial buildings shall be granted in the residential area. It may be mentioned here that over 300 buildings in Quetta have been constructed in violation of the building code.

The bench also directed the Municipal Corporation Quetta, the Superintendent of Police Traffic, and other concerned quarters to submit comprehensive reports about the traffic plans. Commissioner Quetta Division, Asfandyar Khan Kakar also informed the bench about the steps taken by the government to address the issue of traffic jam in the city.
